Utah prosecutors will begin laying out their case against Tyler Robinson this week in a five-day preliminary hearing, aiming to convince state District Judge Tony Graf that there is sufficient evidence to try the 23-year-old for the September murder of conservative activist Charlie Kirk. Robinson faces charges including aggravated murder, felony discharge of a firearm, and obstruction of justice, with prosecutors seeking the death penalty.
According to the Associated Press, the prosecution plans to introduce DNA evidence linking Robinson to the suspected murder weapon, testimony from investigators, findings from Kirk's autopsy, witness statements, and video footage of the shooting at an event at Utah Valley University in Orem, Utah. Additionally, CNN reports that prosecutors will present a videotaped statement from Robinson’s former roommate and possible lover, who will discuss messages exchanged after the killing.
During the hearing, prosecutors must demonstrate reasonable grounds to believe Robinson committed the murder, but they are not required to prove guilt beyond a reasonable doubt—the standard for a trial conviction. Robinson has not yet entered a plea, and his defense team has unsuccessfully attempted to remove the death penalty as a possible sentence. The defense plans to call three forensic experts to testify this week, according to CNN.
Robinson turned himself in less than 48 hours after the September 10 killing, assisted by his parents and a family friend who is a retired detective and sheriff’s deputy. Kirk’s family—including his parents, Robert and Kathryn, his widow, Erika, and his sister, Mary—will attend the hearing for the first time, a source told CNN. In a statement released Monday, they said they “will not be commenting further at this time” as the judicial process unfolds. “Charlie was a beloved husband, son, brother, friend, and father,” the family said. “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.”
